The agreement
These Terms are an agreement between you and Groove App LLC ("Groove," "we," "us"), and they cover your use of the Groove Social app, the venue and host tools, and this website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Groove.
Who can use Groove
You must be at least 18 years old to use Groove.
Using Groove doesn't make you eligible to enter any venue or drink alcohol. Venues set and enforce their own entry rules, including age limits and ID checks.
Your account
Keep your account information accurate and your password secure. You're responsible for everything that happens on your account. Tell us right away if you think someone else has accessed it. You can't sell, transfer, or share your account, and you can't create an account for someone else without their permission.
Your content
You own the photos, videos, posts, comments, reviews, events, and messages you create on Groove ("Your Content"). By posting it, you give Groove a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute Your Content so we can run, improve, and promote the Service. This license ends when you delete Your Content or your account, except where others have already shared it, or where we need to keep it for legal reasons.
Only post content you have the right to share. Get the consent of the people who appear in your photos and videos.
Groovy Feeds posts are temporary and are removed automatically 24 hours after posting.
Community rules
We have zero tolerance for objectionable content and abusive users. Don't use Groove to:
- Post nudity, sexual content, graphic violence, or anything involving minors in a sexual or unsafe way.
- Harass, bully, threaten, dox, or impersonate anyone.
- Post hate speech, or content that promotes violence or self-harm.
- Promote illegal activity, including illegal drug sales, underage drinking, or events that break the law.
- Create fake events, post false cover prices or wait times, or fake "verified" updates.
- Spam, scam, or resell bookings without permission.
- Scrape the Service, interfere with it, or try to access accounts or systems you're not authorized to use.
Uploads are screened automatically, and you can report or block any user, post, comment, event, or account from inside the app. We review reports and act on objectionable content within 24 hours, which may include removing the content and banning the user who posted it.
Venue & event information
Cover charges, wait times, specials, hours, and event details come from venues, hosts, and other users, and they can change quickly. We work to keep this information current, but we can't guarantee it's accurate, complete, or up to date. Check with the venue if something matters to you.
A "Verified" badge means the host has committed to posting photo or video updates during the event. It doesn't mean Groove endorses, organizes, supervises, or guarantees the safety of that event.
Bookings & payments
- What you're buying: table reservations and Instant Entry passes are sold by the venue. Groove provides the platform and processes the payment on the venue's behalf.
- Price and fees: the price shown at checkout includes the venue's price plus a Groove platform fee. You'll see the total before you pay.
- Payment processing: payments are handled by Square, by card or Apple Pay, under Square's terms. We don't store your full card details.
- Guest names: guest names you enter appear on the pass, and the venue may check them at the door. Enter accurate names.
- Entry: venues can still refuse entry, for example for failing ID or age checks, dress code, intoxication, capacity, or safety reasons. A booking doesn't override the venue's rules or the law.
- Not for resale: bookings are for your own use and can't be resold.
Venues & hosts
If you list a venue or host an event, you're responsible for it. That includes keeping its information accurate, holding all required licenses and permits, following the law (including alcohol, capacity, and safety rules), and honoring the bookings you sell.
Venue payouts equal the booking price minus Square's actual processing fee, and are paid out once the payment has settled. Groove may hold or reverse payouts in cases of fraud, chargebacks, or violations of these Terms. Additional terms may apply to venue partnerships.
Groovy Points
You earn Groovy Points by using Groove. Points have no cash value, can't be sold or transferred, and aren't your property. Redemption options are coming soon and will be announced in the app. We may change how points are earned or redeemed, cap them, or expire them, and we may remove points earned through abuse or fraud. Points are forfeited when an account is deleted or terminated.
Going out safely
Groove helps you decide where to go, but your night is your responsibility. Drink responsibly, never drink and drive, look out for your friends, and use your own judgment when meeting people from the app. Groove doesn't run, supervise, or control venues, events, house parties, or user meetups, and it isn't responsible for what happens there.
Our intellectual property
The Groove name, logo, app, and website, and everything in them other than Your Content, belong to Groove or its licensors. You may use the Service only as these Terms allow. If you send us feedback or ideas, we may use them without any obligation to you.
Suspension & termination
You can stop using Groove and delete your account from Settings at any time. We may suspend or terminate your account, or remove content, if you break these Terms, create risk for other users or for us, or if the law requires it. The sections on Your Content, Disclaimers, Limitation of Liability, Indemnification, and Governing Law continue to apply after termination.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY VENUE, EVENT, OR USER INFORMATION IS ACCURATE.
Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, GROOVE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, OR FROM ANY VENUE, EVENT, OR OTHER USER. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID GROOVE IN THE 12 MONTHS BEFORE THE CLAIM, OR $100. Some places don't allow these limits, so they may not all apply to you.
Indemnification
You agree to defend and indemnify Groove and its team against any claims, losses, and costs (including reasonable attorneys' fees) that arise from Your Content, your use of the Service, any event you host or venue you list, or your violation of these Terms or the law.
Governing law & disputes
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Wayne County, Michigan, and you and Groove consent to their jurisdiction. Before filing a claim, please email us first so we can try to resolve it informally.
Apple
If you downloaded Groove from the Apple App Store, these Terms are between you and Groove, not Apple. Apple isn't responsible for the app or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also follow the App Store's Terms of Service.
Changes
We may update these Terms from time to time. When we do, we'll change the date at the top, and we'll notify you in the app if a change is significant. If you keep using Groove after an update, you accept the new Terms.
